Treize lois, pas un prenup national

Si le fichier cite l'égalisation ontarienne alors que le couple vit à Vancouver depuis des années, la question utile est de savoir quelle loi patrimoniale un tribunal appliquerait. Ce produit ne choisit pas le conflit de lois.

Le patrimoine familial québécois est d'ordre public. Coller une renonciation de common law dans un contrat montréalais ne transforme pas le Code.

Où vous vivez, où vous viviez pendant la négociation, et où vous comptez vous marier ou continuer de vivre ensemble.

Si vous êtes déjà des époux pour la loi patrimoniale de cette province, ou si le contrat tente de combler un vide que la loi n'a jamais créé.

Default property position if unmarried

s. 3 treats as spouses persons who are married or who have lived in a marriage-like relationship for a continuous period of at least two years, or who have lived in a marriage-like relationship and have a child together. Unmarried spouses can have Part 5 property claims. That is not Ontario and not Québec.
